Terms and Conditions

Article 1 (Purpose) These Terms and Conditions aim to govern the conditions of use and all operational matters related to the services of “Basantara” (hereinafter referred to as the “Site”).

Article 2 (Definitions of Terms) The main terms used in these Terms and Conditions are defined as follows:

  1. Member: A person who has agreed to the Site’s terms, provided personal information for registration, and has entered into a service agreement with the Site.

  2. Service Agreement: The contract concluded between the Site and the member regarding the use of the Site.

     
  3. Member ID (hereinafter “ID”): A unique combination of letters and numbers assigned to each member for identification and service use.

     
  4. Password: A combination of letters and numbers selected by the member to confirm their identity corresponding to the assigned ID and to protect their rights.

     
  5. Operator: The person who has established and operates the homepage for the service.

  6. Termination: The act of a member canceling the service agreement.

Article 3 (Rules Outside the Terms) The Operator may separately announce operational policies if necessary. If these policies conflict with the current Terms, the operational policies shall take precedence.

Article 4 (Conclusion of Service Agreement)

  1. The Service Agreement is established by the user’s consent to these Terms and the Operator’s acceptance of the membership application from a person wishing to register as a member.

  2. A person who wishes to register as a member and use the services indicates their agreement to these Terms by reading them and selecting “I agree” during the Site’s registration process.

Article 5 (Application for Service Use)

  1. A user who wishes to register as a member must provide all necessary information requested by the Site (such as User ID, password, nickname, etc.).

  2. Members who register false information, such as stealing another person’s information, cannot claim any rights regarding the use of the Site and may be subject to legal penalties in accordance with relevant laws.

Article 6 (Privacy Policy) The Site and the Operator do not possess the password provided during member registration, and all related matters are subject to the Site’s privacy policy. The Operator strives to protect members’ personal information, including registration details, in accordance with relevant laws. Regarding the protection of a member’s personal information, the Operator follows the privacy policy set by the relevant laws and the Site. However, the Operator is not responsible for any information exposed due to the member’s negligence. The Operator may, upon request from relevant authorities, review and submit a member’s data if the member registers or distributes illegal posts, such as those that are harmful to public morals or violate national security.

Article 7 (Operator’s Obligations)

  1. The Operator must process opinions or complaints raised by members as quickly as possible if they are deemed justified. However, if a quick resolution is difficult due to personal circumstances, the Operator will do their best by providing a notice or sending messages or emails to the member afterward.

  2. The Operator may require the Site to repair or restore equipment without delay if a failure or loss occurs to provide a continuous and stable service. However, the Site’s operation may be temporarily suspended in cases of natural disasters or other unavoidable circumstances for the Site or the Operator.

Article 8 (Member’s Obligations)

  1. Members must comply with the matters stipulated in these Terms and all regulations, notices, and operational policies set by the Operator, as well as relevant laws. Members must not engage in any activities that interfere with the Site’s operations or damage its reputation.

  2. Members may not transfer or donate their right to use the service or their status under the Service Agreement to another person without the Site’s explicit consent, nor can they provide it as collateral.

  3. Users must take considerable care in managing their ID and password and may not allow a third party to use their ID without the consent of the Operator or the Site.

  4. Members must not infringe on the intellectual property rights of the Operator, the Site, or any third party.

Article 9 (Service Usage Time)

  1. Service usage time is, in principle, 24 hours a day, 365 days a year, unless there are special business or technical obstacles. However, the Site may temporarily suspend services on days or times determined by the Site for regular system maintenance, expansion, or replacement. Users should regularly check the homepage for advance notice of such service interruptions.

  2. The Site may temporarily or permanently suspend services without prior notice in the following cases:

    • In case of an emergency system check, expansion, replacement, failure, or malfunction.

    • In case of an unavoidable reason such as a national emergency, power outage, or natural disaster.

    • If the main telecommunication business operator, as stipulated in the Telecommunications Business Act, has suspended telecommunication services.

    • If there is an obstacle to normal service use due to a sudden increase in service usage.

  3. In case of service suspension under the preceding paragraph, the Site will notify the members in advance through notices. However, if prior notification is not possible due to a service interruption caused by reasons beyond the Site’s control, a post-suspension notice will be provided instead.

Article 10 (Termination of Service Use)

  1. If a member wishes to terminate the Service Agreement with the Site, the member must submit a registration termination request online themselves. In addition, the termination of the service agreement with the Site is separate from the termination of the Site’s services.

  2. Upon the termination request, the Site-related program provided by the Site will be automatically deleted from the member management screen, and the Operator will no longer be able to view the information of the termination applicant.

Article 11 (Restriction of Service Use) A member must not engage in any of the following acts. If they do, the Site may restrict the member’s service use, take appropriate measures, terminate the service agreement, or suspend the service for a specified period.

  1. Registering false information during or after membership registration.

  2. Obstructing the use of the Site by others or stealing their information.

  3. Impersonating the Site’s management, employees, or related personnel.

  4. Infringing on the personal or intellectual property rights of the Site or any third party, or obstructing their business.

  5. Illegally using another member’s ID.

  6. Collecting, storing, or disclosing another member’s personal information without their consent.

  7. Acts that are objectively judged to be related to a crime.

  8. Other acts that violate relevant laws.

Article 12 (Management of Posts)

  1. The responsibility for managing and operating the Site’s posts and data lies with the Operator. The Operator must constantly monitor for inappropriate posts and data. Upon discovery or receiving a report of such posts, the Operator must delete them and issue a warning to the member who registered them. Members are responsible for their own posts, so they must not post anything that violates these Terms of Use.

  2. If public institutions such as the Korea Communications Standards Commission request correction, the Operator may delete or move a post without the member’s prior consent.

  3. The criteria for judging inappropriate posts are as follows:

    • Content that severely insults or defames another member or a third party.

    • Content that violates public order and morals or links to such content.

    • Content that encourages illegal copying or hacking.

    • Advertisements for commercial purposes.

    • Content that is objectively deemed to be related to a crime.

    • Content that infringes on copyrights or other rights of other users or third parties.

    • Other content judged to be in violation of relevant laws.

  4. If the Site or the Operator receives a request to suspend a post from a third party due to defamation, infringement of intellectual property rights, etc., the post may be temporarily suspended. The Site will comply with any decisions made between the requestor and the post’s author, such as a lawsuit, settlement, or a similar decision from a relevant institution.

Article 13 (Retention of Posts) If the Site Operator is forced to suspend the Site due to unavoidable circumstances, they will notify members in advance and make every effort to facilitate the easy transfer of posts.

Article 14 (Copyright of Posts)

  1. The copyright of a post published by a member on the Site belongs to the member who published it. The Site may not use the post for commercial purposes without the author’s consent. However, this does not apply to non-commercial purposes, and the Site has the right to publish the post within its services.

  2. Members may not commercially use the materials posted on the service, such as arbitrarily processing or selling information obtained through the service.

  3. If the Operator determines that the content or posts registered by a member on the Site fall under any of the clauses in Article 12, they may delete, move, or refuse to register the content without prior notice.

Article 15 (Compensation for Damages)

  1. The primary civil and criminal liability for all damages occurring on this Site rests with the member themselves.

  2. The Site is not liable for damages received by a member if they are caused by force majeure, such as a natural disaster, or by the member’s own intentional act or negligence.

Article 16 (Disclaimer)

  1. The Operator is exempt from liability for any benefits the member fails to gain from the Site’s services or for any damages resulting from the selection or use of service materials.

  2. The Operator is exempt from liability in cases of failures of the Site’s service infrastructure or telecommunication services provided by other telecommunication companies. Any damages arising from the Site’s service infrastructure are subject to the Site’s terms of use.

  3. The Operator does not assume any responsibility for materials saved, posted, or transmitted by a member.

  4. The Operator is not responsible for any service interruptions caused by the member’s negligence.

  5. The Operator is not liable for any activities between members, between a member and a third party, or any other activities of the member, whether inside or outside this service (including data transmission and other community activities).

  6. The Operator is not responsible for the authenticity, reliability, or accuracy of the materials posted or transmitted by a member or all materials that a member can receive from this Site.

  7. The Operator is not responsible for any damages arising from transactions of goods or other items between members or between a member and a third party using the service as a medium.

  8. The Operator is not responsible for any disputes that arise between members or between a member and a third party without the Operator’s negligence.

  9. The Operator is not responsible for damages to members resulting from system failures that may occur during the management, inspection, maintenance, or replacement of equipment like servers, or during the operation of software, without intent or gross negligence on the part of the Operator. This also includes system failures caused by attacks from third parties, the spread of computer viruses for which no countermeasures have been developed by renowned research institutions or security companies, or other force majeure reasons beyond the Operator’s control.

Addendum These Terms and Conditions shall take effect from [Site Launch Date].
